What DUI Means in Georgia
Under Georgia law, driving under the influence (DUI) occurs when a driver operates a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher, or while impaired by drugs or alcohol to the extent that it is less safe to drive.
Penalties for a DUI conviction can include the following.
First offense: 24 hours up to 12 months in jail, fines, license suspension, community service, and mandatory DUI education.
Second offense: Increased fines, longer license suspension, mandatory community service, and mandatory jail time for 72 hours up to three days.
Third offense: Misdemeanor of a High and Aggravated Nature, extended license suspension, mandatory community service, and a minimum of 15 days in jail.
Fourth offense: Felony charges with mandatory prison time and extended license revocation.
Additional charges may apply if the DUI involves drugs, prescription medications, or if you caused an accident resulting in injury or death.
